The European Biodiesel Board (EBB) has expressed its approval following the adoption of definitive anti-dumping duties on biodiesel (HVO and FAME) from China by EU member states. These duties were initially introduced as provisional measures in July of last year but required approval from the national governments of EU member states. This approval was granted on January 8, during the Trade Defense Instruments Committee’s formal adoption of the European Commission’s proposal. The definitive duties will be implemented for the next five years.
Although the protection against Chinese biodiesel imports is not yet flawless, and further work is needed to ensure effective enforcement, the EBB has thanked the European Commission for its efforts and the positive impact on the European biodiesel industry.
Xavier Noyon, Secretary General of the European Biodiesel Board (EBB), commented: “It has been a long journey for the EBB, beginning with the circumvention case and followed by this anti-dumping case. After taking action against Indonesia, Argentina, and the USA, we now have measures in place to address China. In the coming weeks and months, it will be essential to monitor the trend of biodiesel imports, especially considering the recent Chinese export tax on used cooking oil. We will also be vigilant for circumvention, as no duties have been imposed on Sustainable Aviation Fuel (SAF), and some companies have received lower anti-dumping duties than others.”
The next step in the process is the publication of the Implementing Regulation, which will formalize the definitive duties in the EU Official Journal. These measures will be effective for five years, with the publication of this regulation expected by February 14, 2025, at the latest.
